Chapel of the Chimes

1. Purpose. This Agreement governs the funeral, mortuary, cremation, burial, interment, transport, and/or related services requested by the CLIENT.
2. Authority & Representation. The CLIENT warrants that they are the legal next of kin or a duly authorized representative with full authority over custody and disposition of the Deceased.
3. Scope of Services. Only services and items selected and itemized in the attached Statement of Services and Charges shall be provided. Any additional service is subject to separate charges.
4. Embalming / Preparation. The CLIENT authorizes appropriate preservation procedures in accordance with applicable laws, health regulations, and professional standards.
5. Disposition Authorization. The CLIENT understands that cremation is irreversible and releases the company from liability once cremation has been lawfully completed.
6. Custody of Remains / Ashes. Unclaimed remains after thirty (30) days may incur storage fees. Continued non-payment or abandonment may result in lawful retention or disposition per Philippine law.
7. Fees, Payment & Client Liability. The CLIENT remains personally, jointly, and solidarily liable for the full amount once services are rendered. Balance must be settled at least three (3) days prior to burial or cremation.
8. Taxes & Third-Party Costs. Government fees, permits, cemetery fees, and third-party services are not refundable once incurred.
9. No Guarantee of Timelines. Delays caused by government offices, hospitals, weather, transportation, or force majeure shall not constitute breach.
10. Limitation of Liability. Liability, if any, shall be limited to the amount actually paid under this Agreement.
11. Possessory Lien. Until full payment is received, the company retains a possessory lien over the remains and related documents.
12. Personal Effects Disclaimer. The company shall not be responsible for jewelry, cash, or valuables left with the Deceased unless declared and documented in writing prior to preparation.
13. Additional Services. Services requested after signing may result in additional charges.
14. Data Privacy. The CLIENT consents to the collection and processing of personal data under R.A. 10173.
15. Governing Law / Venue. Governed by Philippine law. Disputes shall be filed in the proper courts of Bacolod City. Attorney's fees equivalent to 25% of the outstanding obligation if legal collection becomes necessary.
16. Entire Agreement. This Agreement and any written addenda constitute the entire agreement. No verbal statements shall modify this Agreement unless in writing and signed by both parties.
17. Acknowledgment. By signing, the CLIENT confirms understanding of the terms and voluntary consent to all provisions herein.

All deposits and payments made under this Agreement are strictly non-refundable, regardless of the reason or timing of cancellation. Once a deposit or any partial payment has been received by Chapel of the Chimes – Gegato-Abecia Inc., it is deemed earned and shall not be returned under any circumstances, including but not limited to change of plans, transfer to another service provider, or death of the responsible party.

The Contractee acknowledges that Chapel of the Chimes – Gegato-Abecia Inc. reserves chapel space, personnel, and resources exclusively upon confirmation of payment, and that cancellation results in direct loss to the company that cannot be recovered.

Acknowledgment and Assumption of Risk: I acknowledge that the use of loft or bunk beds involves inherent and unforeseeable risks of property damage, severe personal injury, or death. I voluntarily assume all such risks.

Full Release and Waiver: I hereby irrevocably RELEASE, WAIVE, AND FOREVER DISCHARGE Chapel of the Chimes – Gegato-Abecia Inc., its directors, officers, employees, agents, and representatives from any and all claims arising out of or connected to the use of the loft bed facilities.

Indemnification: I expressly agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS Chapel of the Chimes – Gegato-Abecia Inc. from any claims resulting from use or misuse of the loft beds by anyone in my party.

Strict Usage Rules: Jumping, playing, horseplay, climbing outside designated ladder areas, or rough use of the loft beds is strictly prohibited. The administration reserves the right to immediately revoke access or terminate the rental without refund if these rules are violated.

• Disturbances: Zero-tolerance policy against altercations. Violations may restrict viewing privileges to immediate family only.
• No Cooking or Open Flames: Strictly prohibited inside the chapel and viewing rooms.
• Noise: Sound systems at reasonable volume at all times. After 10:00 PM, audio must not be heard outside the rented room.
• Guest Capacity: Must not exceed posted maximum occupancy limit at any time.
• Curfew & Parking: Main gates close at 11:00 PM. Park at the back of the facility at night.
• Children must always be supervised and should not run or play inside the chapel.
• Prohibited: Smoking/vaping inside, gambling anywhere on premises.
• Pets are not allowed inside the chapel.
• Outside Vendors must be approved by the Provider in advance.
• Decorations: No tape, nails, or staples on walls. Freestanding decorations only.

The Contractee agrees to leave the chapel room in the same clean and orderly condition as received, including proper disposal of trash and removal of personal items and decorations. The full remaining balance must be settled on or before the day of pull-out. Delays caused by non-payment may result in additional rental days being charged.

Families are responsible for their personal belongings. Any damage to facility property caused by the Contractee or their guests will be charged to the family. The Provider reserves the right to terminate this Agreement immediately if any terms are violated or conduct becomes disruptive or illegal.

Data Privacy: Personal data is processed in compliance with R.A. 10173 (Data Privacy Act of 2012) solely for managing the rental arrangement and legal record-keeping.

Governing Law: Governed by Philippine law. Disputes shall be submitted to the proper courts of Bacolod City, Negros Occidental. Attorney's fees equivalent to 25% of the amount in dispute if legal action is necessary.

Entire Agreement: This Agreement constitutes the entire agreement. No verbal modifications are binding unless in writing and signed by both parties.
